The passage of Automatic Expungement (HB 431)

HB 431 will create an automatic expungement process for low level offenses for offenders who remain crime free for a period of time.  The criminal justice system relies on the premise that people can be better than their worst mistakes. Today the Utah Legislature unanimously supported that concept with the passage of HB431, Expungement Act Amendments. While people should be held accountable for their actions, they should also be able to move on after they have paid their debt to society.

We applaud the Utah State Legislature for making this important policy decision. Utah is the second state in the nation to create such a streamlined clean slate process and the Salt Lake County District Attorney’s Office looks forward to working with the Administrative Office of the Courts and other stakeholders to bring this program online in the coming year.

“I couldn’t be prouder of our office helping draft this legislation. The Salt Lake County District Attorney’s Office continues to be committed to criminal justice reform and will keep looking for ways to improve our justice system. Thank you to the Utah State Legislature for passing this bill, and for the support of our county leadership.”
