SLCo DA’s Office filed criminal charges against Justin Gary Llewelyn

Salt Lake City, UT – The Salt Lake County District Attorney’s Office, filed criminal charges against Justin Gary Llewelyn for his alleged role in a January 20, 2018 shooting, robbery and burglary in Herriman, Utah.

It is alleged that the first responding officer, a Unified Police Department (“UPD”) sergeant, was investigating possible vehicle burglaries when he saw a man later allegedly identified as Mr. Llewelyn.  As Sgt. Wilson ordered Mr. Llewelyn to stop, Sgt. Wilson said he heard Mr. Llewelyn allegedly shooting a gun.  UPD Officer Weeks, who arrived in the area, said Mr. Llewelyn allegedly shot at him.

It is alleged that Mr. Llewelyn fled the area, broke into a home belonging to Steven Smith, shot Mr. Smith in the chest, stole his car, and fled.  A few days later, acting on information relayed in an anonymous tip, police officers arrested Mr. Llewelyn in Utah County. 

The District Attorney’s Office charged Mr. Llewelyn with the following criminal offenses:

  • Two counts of Attempted Criminal Homicide, Aggravated Murder, First Degree Felonies (one count for Mr. Llewelyn’s alleged attempt to kill Officer Weeks, and one count for Mr. Llewelyn’s alleged attempt to kill Mr. Smith)
  • One count of Aggravated Robbery, a First Degree Felony, for Mr. Llewelyn’s alleged unlawful theft of Mr. Smith’s vehicle and causing serious bodily injury while allegedly doing so and or using a dangerous weapon.
  • One count of Aggravated Burglary, a First Degree Felony, for Mr. Llewelyn’s alleged unlawful entry into Mr. Smith’s home with a dangerous weapon with the intent to commit a theft and/or assault
  • One count of Criminal Mischief, a Third Degree Felony for Mr. Llewelyn’s alleged damage he caused to Mr. Smith’s truck.
  • One count of Failure to Stop at the Command of a Law Officer, a Class A Misdemeanor, for Mr. Llewelyn allegedly running away when Sgt. Wilson ordered him to stop.

In Utah, a First Degree Felony is punishable by a maximum possible sentence of up to life in prison; a Second Degree felony is punishable by a maximum possible sentence of up to fifteen years in prison; a Third Degree Felony is punishable by a maximum possible punishment of up to five years in prison; a Class A Misdemeanor is punishable by up to a year in jail.
